There's a difference between software enabled LEDs and hardware enabled LEDs. AFAIK, the former is much more common with professionally designed devices. Which means you can have software enable the camera and mic, while disabling the LEDs. That's what I don't like.
There's also a ton of things that cause fatigue. I'm also told not to have caffeine. Whenever I travel east, I'm dead.

The difference is that the Kinect would likely be pointed towards me when I'm sitting by the TV. My phone camera would be pointed down at a table when I don't use it, and away from me when I am using it. I'd feel more comfortable if there were LEDs in series with the camera/mic when they're enabled, however.
