He was certainly arrested and found guilty on draft evasion charges. While he may have spent most of his time on bond appealing his conviction he definitely had to have spent time after his arrest in jail.

No I mean that it's really not true in Europe. And was only true in a handful of American cemeteries and none right now. If his particular cemetery is going to forbid them that's pretty contrary to standard ops.

Actually the part about not being able to be buried with tattoos is an American urban myth. Especially when it comes to involuntary ones.
