Actually, I would argue that incarcerating the mentally ill instead of treating them is exactly what causes mass incarceration. Do you know where the largest mental health facility in the United States is located? The Los Angeles County Jail.

As my original comment made clear, I`m referring to pre-trial prosecutorial discretion. The prosecution can decide not to bring charges if she is mentally ill and instead opt to use other means of rehabilitating her. Rehabilitation is what our criminal justice system (supposedly) aims to do. It is not a retributive

Once the prosecutor moves forward with the charges, that is somewhat true. But until that point they have all the discretion in the world to drop them.

Maybe it has to do with portrayal of law enforcement in Wisconsin? Tough luck. They shouldn’t be such assholes if they don’t want to be portrayed that way.

While it’s not produced by Netflix or NPR, The Central Park 5 is one of the best documentaries about the failures of the criminal justice system and is absolutely worth a watch. It tackles the racial elements of these true crimes series well.

Oh man. I really hope the prosecutor gets a fair and credible mental health assessment done before deciding to move forward with a trial or even plea negotiations.
