Actually, I would argue that incarcerating the mentally ill instead of treating them is exactly what causes mass incarceration. Do you know where the largest mental health facility in the United States is located? The Los Angeles County Jail.

The prosecution can decide not to bring charges if she is mentally ill and instead opt to use other means of rehabilitating her. Once the prosecutor moves forward with the charges, that is somewhat true. But until that point they have all the discretion in the world to drop them.

While it’s not produced by Netflix or NPR, The Central Park 5 is one of the best documentaries about the failures of the criminal justice system and is absolutely worth a watch. It tackles the racial elements of these true crimes series well.
