I was curious so looked it up but it’s unclear. The issue is that in Texas they apparently don’t use “first-degree”/“second-degree” in labeling murder charges - they just call everything “murder” even though there IS a legal distinction on requirements for charging/sentencing. My interpretation is that Pelosi thinks this is an avenue with a high chance of success. From what I’ve seen of her, she absolutely hates posturing or looking politically motivated in her actions, such that she has two modes: quiet governance and stabbing her enemy in the kidney.

True story: I was lying in bed this morning thinking about impeachment (so? what do you think about?). I was remembering some stories last week about how Pence had his fingers in this whole Ukrainian mess. And I thought, if Trump gets impeached, and Pence is found complicit then Nancy Pelosi will be president.

Perhaps he was drinking or doing drugs. Perhaps he’s not a citizen. Perhaps he’s gay or bi or trans. Perhaps he knows his attackers. Perhaps he thinks that pressing charges will only make him a target of more hate and violence.
