Apparently there currently is an issue with having the phones activated.. I just spent a while on the phone with sprint and they couldn't find anything preventing it... it may be on google's side

In theory, doesn't Itunes let you download in a higher quality? I know amazon is 256kbps MP3, but itunes is 256kbps AAC (M4a), which in theory has the ability to be higher quality ( i think)

Its legal because it can only be used in a way that the police legally have the right to search your phone.. aka search warrant or probable cause

Since the software is only for law enforcement.. that may have been the best they could have done, short of installing screen-capture software on a police computer
