Sorry, I should've clarified, but when I say "emulator" I mean everything that it encompasses, which the main part would be the BIOS, since the emulator is nothing without it.

ROMs for old games (especially console/handheld) are typically tiny and hosted on direct-download servers, so torrenting isn't a huge source (in my experience, anyways).

The illegal part is actually downloading the ROM, meaning you've accessed a particular set of software without paying for it. The emulator itself would be considered illegal by proxy (if that's even a thing) since its main purpose is to make ROMs work.
