The article suggests iCloud would use the metadata from the song to identify it. Metadata is built into tracks/albums during the mastering process. As far as I know, assuming the person who uploaded the song for downloading ripped from the CD correctly, it should be ok. If they downloaded it from iTunes or something

Subscription services also depend on copyrights from publishing houses. Spotify is one such service and it's a great one, but it only exists in certain places (like the UK) because it can't get licensing in countries like the US.
