As far as I know, assuming the person who uploaded the song for downloading ripped from the CD correctly, it should be ok. If they downloaded it from iTunes or something…
Subscription services also depend on copyrights from publishing houses. Spotify is one such service and it's a great one, but it only exists in certain places (like the UK) because it can't get licensing in countries like the US.
Spotify is only available in certain countries. If we had it in the US, I'd be all over it and this whole iCloud thing would be quite as interesting to me. But, since we don't; the iCloud would be awesome for me/anyone outside of Spotify's coverage area.
What makes you think you have to buy it on iTunes? The songs are identified based on metadata, which is built into the song/album during the Mastering process. Why spend time/effort/money to fix a network that is about to be made obsolete by the new one? They are doing a combination fix/upgrade by redoing their coverage in the LTE protocol.
