It actually has more to do with the electrical system than anything. per SAE testing standards, the US-spec WRX’s need to have their horsepower rated while charging 3 vape pens. The added load on the alternator is why the US Subarus have a lower horsepower rating.
It’s not always cheating so much as it is creative interpretation of the rules and looking for loopholes. Doing things the rules don’t explicitly prohibit.
