Don't get me wrong, the monitoring capabilities in combination with the Patriot Act makes the XBone a serious privacy threat. That being said, it has nothing to do with video games being a free market.

How are video games not a free market? They are one of the few that hasn't been riddled with regulations and government interference. You just don't like the new products, but you are free not to purchase them.
