Yeah, my gut feeling is that it’s going to be far too easy for a judge to rule that there hasn’t been any actual harm yet as they aren’t in the US and haven’t actually attempted entry.
A document I’m scanning through and, like I said, seems to be based around the concept of suing someone for an offence that hasn’t taken place yet in a country they haven’t even entered yet.
Which is all well and good, but the Federal government hasn’t actually breached that agreement yet. They may have said they were going to, but they haven’t. And if said minors never enter into US custody, they won’t have, at least where the premise of the suit is concerned in relation to this article.
Sadly, I think they played their hand a little too soon because there has been no actual harm to the plaintiffs yet. They would have a better chance if they waited until after there was an actual affirmative action on the part of the Trump administration beyond just Trump puffing his chest before an election.
This isn’t a defence of Trump’s disgusting policies but I’m confused as to how people can sue a country they aren’t in for an act that hasn’t taken place yet.
