They have fixed that. It is now linked to your club Nintendo account. Atleast from what I can tell. I just bought a Wii U and you can lookup what you have downloaded.

I won't buy one unless it comes in white in the standard size. I want those all colored buttons so bad. It's retro SNES and I've been eyeing it for months.

Same situation here. Don't own a 3DS. Was going to buy the White New 3ds. I've got huge hands but I like the smaller form factor. I HATE the XL. Guess I can sell off the games I bought on Black Friday as I won't be buying one now.
