If Hamilton was quick enough he could have passed Rosberg. The entire track was wet, so no excuses about going off the racing line into the wet.

I believe that that rule looks at the situation when the move is initiated, not halfway or more into the move as in your image. Hamilton was driving into a closing gap and did not have any significant part of his car alongside Rosberg until ‘late’ in the incident.
