I believe that that rule looks at the situation when the move is initiated, not halfway or more into the move as in your image. Hamilton was driving into a closing gap and did not have any significant part of his car alongside Rosberg until ‘late’ in the incident.

That is after the defensive move was already started. At the moment Rosberg started his defensive move, Hamilton did not have a nose in the gap in any way. And with the gap closing, Hamilton could have lifted and moved to the left. Instead he continued and paid the price.
