I am having a hard time understanding the legal kung fu being played here. From my understanding, a woman cannot be considered to have given true consent if she is intoxicated enough. But the man is trying to use the same argument, right? That he was too intoxicated to knowingly have raped or even sexually…

I agree with this. We have a 3-year-old and if she is intentionally being whiny or refusing to do something, she gets 5 seconds to comply on her own. If she doesn't, then we physically remove her from the situation. She almost always does it on her own now, after realizing we are serious about it.
