Good points. For all the discussion of how "brave" this series is in showing life in the 18th century, the show is really not so brave after all. Everything still has a 21st century gaze to it. An episode featuring Jamie beating Fergus would have been viewed with outrage - even though it was a normal punishment

Fergus was a child prostitute in the book. He was a street kid. The TV series writers changed it - made him just a pickpocket for TV. I'm sure there were many child prostitutes in those days. It doesn't make him any less a victim. The show just never brought it up in previous episodes, so they had to change it

The child actor is French, and I believe this was filmed in Scotland. American laws wouldn't apply as far as the actual filming. I don't know about laws in the UK or France. Brianna (that little girl grown up) is a totally obnoxious Mary Sue in future Outlander books. I barely got through book 4 because I disliked her so much. If they continue the TV series they will need to make some serious adaptations from the books - especially with her.
