I think there's not many games this year... the worthy ones I mean.
Gamers now only want instant gratification and explosions. Old fashioned adventure games is too slow and boring for those short attention spans.
Alter software and hardware are totally different matters. I doubt SONY will give a shit when you paint your PS3 pink or take it apart or smash it. You don't own the software, what you have is just a licences to use it. It might not be in everybody's favor, but it's a very common practice in software industry.
He could have chosen not to agree to upgrade the system. As long as has agreed with the updated EULA, SONY has the very right to take legal action once it's violated. Also not to mention he tried to threaten SONY. I don't get where people get these kind of sense of entitlement from.
