As I recall, you can use the FBI and other federal agencies in fiction, but recreating their logos is where it gets tricky. I think the X-Files badges rearrange “Federal Bureau of Investigation” because it’s a felony to create fake government ideas.

Brainiac 5 has been portrayed as believing “the ends justify the means” for the last few decades. Toss that in with the entire Legion being manipulative dicks throughout the Silver Age and you get a Brainiac who would work with Lex Luthor to get what he wants.
