That is a great question. Like another commenter said, I would argue that he is 1. Not making the claim and/or 2. Did not knowingly make the claim. If it is proven, he may not have any waivers available to him.

If I recall the Bland case correctly, the jailers were falsifying the sheets showing they checked the cells (i.e. filled them out at the beginning of the shift then sat on their lazy asses).  If one of the changes was that they actually did their job, checking on the prisoners may have actually saved this guy’s life.
