Honestly, this is kinda an example where competition isn't super good for consumers. Having a situation where game performance can be dependent on which manufacturer you use, and there's no way of knowing which games will favor which cards ahead of time, is pretty shitty.

I doubt they got paid, but I wouldn't be surprised if part of the reason they decided not to try and fix the graphical settings was to keep a certain level of parity between the platforms so as to not potentially anger Sony or Microsoft. That's absolutely a thing that happens in reality though, not a conspiracy theory.

You don't need legal to approve this type of statement. This is the type of thing their PR/communications team comes up with, runs by the developers, and then finalizes and sends out.

Unfortunately, you're right. Big companies generally shrug off controversy pretty easily. Having a ton of money to spend on marketing/PR, and dedicated fans of their other series does wonders.

A bit. The big downside is that there are graphical glitches that come along with it (texture flashing etc.), but it was just extremely surprising to folks that enabling these settings didn't cause them to take huge performance hits, because they absolutely should have.
