Sometimes, when a judge thinks a case is really going in one direction, they’ll throw the other side a bone or two. That’s not because they want the case to come out the other way, but because they want to make sure that the other side cannot complain that an adverse ruling was “harmful error.”

That’s an interesting decision.  Generally, a criminal defendant takes their victim as they find them.  It’s analogous to the “eggshell skull” rule in civil law, that says that a defendant doesn’t get a pass merely because the plaintiff was more susceptible to harm than the defendant anticipated.
