What I’m suggesting is that there’s a legal path to accomplish this by doing a clean room version of the engine and distribute it stand-alone with no assets. If they don’t do it, someone else can.

They would not rebuild the game, just the engine, like with ScummVM.

They can release the engine stand-alone like ScummVM and then it's up to you to supply the assets.

Who would want to buy an item in a game that way, depriving themselves of the gameplay experience of progressing through the game and unlocking it? Also games like Diablo have in game market places that don’t use NFTs so why even bother with the part that requires resource consumption?
