No, I didn't. And at first glance, when you only take the first part of that sentence into account it does indeed read that way. It's the last part that seemingly changes the entire meaning of the law. That's why when I quoted the end I used bold to highlight how it changed things.

One of which works at a local courthouse in collections (no not a lawyer or judge, but at least a bit more familiar with law than I am) yet in the case you linked a defendant was indeed able to skirt by a hefty drug smuggling charge
