No kidding they misjudged the risk. There was obvious serious incompetence on display. But that doesn’t mean they were disregarding the rules.

How do you know? No ship captain on earth is going to maintain course and speed with another ship CBDR on him. Obviously either a) the two ships didn’t see each other or b) there was a miscommunication about what each was going to do.
