That’s an accurate summation of my opinion, yes. I have more thoughts on the idea of “born this way” and the inadequacies (and benefits) of labels but that’s pretty tangential.

There already are restrictions on speech, including those based on intellectual property rights. You may disagree with how those laws are handled but don’t pretend this is unprecedented.
I think your interpretation is an interesting one but it relies on the knowledge that the piece is connected to historical hangings and lynchings. Without that knowledge, it’s just a weird climbing structure. I wonder whether the historical significance is communicated effectively to the casual visitor.

Watching Masterclass made me like Paul a bit better but even more so it convinced me that the Bake Off needs Paul and Mary and Mel and Sue to truly work. Paul and Mary have a cute dynamic on their own but it feels too “morning show host” without Mel and Sue giving them something to contrast with.
Educating people about the dark parts of the past is important but we should examine whether that’s actually taking place. The piece was put in a public sculpture garden and used as a playground. That doesn’t seem a good way to introduce painful and nuanced topics like Native history in the US and state violence.
Personally grappling with your anscestors’/your history as an oppressor is necessary and art can be a powerful tool to do that. But once it’s put out into the public sphere, you have to be cognizant of possible additional harm you might inflict.
