Splitting hairs over whether ore not to call it a defect is why i disagreed with you. It’s a very clear product use defect and whether you want to call it a design flaw or defect doesn’t change that they didn’t design the shifter for foreseeable misuse.

Not having appropriates safeguards against foreseeable misuse is absolute a defect. It wasn’t a mechanical, electrical or software defect, but it was a product use defect which is something we’re expected to design out of consumer goods.

Clearly dominant players mean literally nothing if those players are unwilling to put the capitol investment into your vision of the future.
