There are limits when the constitutional question has already been mostly answered but it doesn't definitely violate the constitution until SCOTUS rules it does. It's the judicial branch that interprets constitutionality, not the president. I'm pretty sure until they issue a ruling that covers an issue, it is neither constitutional or not.
