What’s amazing is that the NFL is so bad at this that they’re getting overturned even under the incredibly broad discretion the CBA gives Goodell. As much discretion as the CBA gives Goodell to make the final decision, it still requires there to be some process, and for the NFL to follow its own rules.

That contract that the NFLPA signed required that Goodell give players a fair, impartial hearing before subjecting them to his power. He (and his arbitrator) did not do that, and that’s why the judge ruled as he did.

The NFL has the right to suspend Elliot, but they’re required to give him a fair hearing before they do so. Whatever else may have happened, it’s clear they didn’t do that, because of course they didn’t.

Never ceases to amaze me that some people who think they are smart talk about contract law like it is the word of god and if you sign anything you are bound by it. It’d be really hard to find a Federal Judge willing to accept a bribe. Judges are appointed for life (on good behavior) so they are almost completely politically insulated, needing neither public support nor money for campaigns.

He did lose in court. The NFL was in court to prevent the injunction. They lost.

It was the NFL that set up the process, made the NFLPA agree to it, and then to much acclaim brought in highly qualified people to administer it. Yet on the very first test of their newly agreed upon process, Goodell and the NFL didn’t like the result and essentially said, “Fuck it, let’s suspend him anyways.”

You realize that they still have to abide by that contract, right? The judge here said the NFL egregiously failed to meet their own bare minimum standard, in a way “unmatched by any case this Court has seen.”

Sexual assault is a crime regardless of where it occurs. She should have reported this to the police and asked for protection if she thought that was necessary. She should not rely on her school to deal with the issue.
