I see your point, but lacking a stock and any vertical foregrip it can be classified as a pistol by the ATF. There are many Kalashnikov patterned "pistols" out there that fill the pistol role poorly.

I can't from the picture if it has a stock, so it may actually be a Kalashnikov pistol. I can guess he barely knows how to use it though.
