Lets rework this scenario to one thats just as realistic:

Lenders dont want to go to court either for the same reason. Its why you adult-up, call them, and figure out how to settle. Even if it means a lot of yelling. 

Certainly works both ways! If the person in question had fought this in court, its likely the lender wouldve had to taken pennies on the dollar. Taking responsibility for both parties:

These lenders are scumbags and they prey on the willingly ignorant...doesnt absolve someone for not understanding that type of loan before putting their name on the dotted line.
