@Adora Belle Dearheart: I went to a private school (which they can discriminate all the want, but ignoring that fact) and you had the option of single sex floors or coed floors. I'm purposely saying floors because the dorms were all mixed. I choose single sex my first year. It was for my comfort in the communal

@nobodyr: It's equal across genders though. If she stated that they wouldn't let her be an RA on a woman's floor because she was a lesbian, then yes you would be right. There would be discrimination. But allowing for same sex dorm living and applying that rule to the people who will both work and live on the floor?

@Adora Belle Dearheart: For sure intermediate scrutiny, but do you really think there's no compelling interest? Dorms typically have communal bathrooms. Having a female RA in a male bathroom is a problem, as is vice versa. I'm not talking about moral decency, so much as the potential for harassment suits, student

This is a dorm living situation. It shouldn't matter if the school is private or public. It's about keeping students comfortable and being around someone who has the same body parts as you.
