i said this above, but marvel does have the rights to the skrulls. they haven't been introduced because their whole shapeshifting deal is complicated and not really necessary when you're just looking for a generic alien villain.

marvel actually have the skrulls as well - they weren't included in the avengers because whedon didn't want to have to introduce their ability to shapeshift when it wasn't really relevant to the plot
