this one may be a bad example since it happened in florida and the guy who did it was probably well known as being certifiably insane so there's a good chance he got his firearm from a private sale, bypassing the background check system entirely which in many states is already against the law.

if you're buying a gun at a gun store you're buying through a licensed dealer that is required by law to perform a federal background check. the issue is with private gun sales between individuals i.e. the "gun show loophole" that don't require a background check
