@InfiniteJustice: Read all of you posts, and they are filled with misinterpretations and incorrect statements of the law. Every post you have to clarify after the fact, because what you are saying is not correct as a matter of law. Back to the bicep curls.

@InfiniteJustice: Obviousness has nothing to do with whether or not a trademark is registrable. That is a concept related to patents and invalidating prior art. The term you are looking for is "descriptive" or "generic."

@manimatr0n: I was looking at the dates claimed in their actual TM registrations, not wiki.

"Fair Use" has nothing to do with why the USPTO would or would not grant a trademark. "Fair Use" is a defense to TM infringement. I have NEVER, EVER seen an Examiner reject

@Ian Logsdon: Agreed. Ugh, that extra "not" in my post is embarrassing. Once again proving the golden rule of posting.

@Alfisted: Aggies have a first use date of 12th MAN for scholarship services in 1965. The "cheering section" type uses seem to have first use dates of the early 80's. Let the priority contest begin.

@Ian Logsdon: General comment to the thread — why is everyone not forgetting about Apple's common law rights to FACETIME. U.S. law does not require registration to enforce or use a mark.

@kevipants!: +1. Although, I am not sure if they can show use of the mark FACE that is not in conjunction with FACE BOOK. Most Examiners won't let you sneak in other terms on an SOU. Maybe on a renewal you can get away with it, but not for the initial AAU.
