I wonder if Apple's little reputation as a "ruthless bully who will slit the throat of a content provider as soon as it is entrenched in any given market sector" played into this?

I've seen this work before.....

@djdare: I think of it like a toll road. You pay taxes to maintain all the roads in your state, but if you want to take the most convenient route, it may cost extra. Toll roads suck, but they persist because millions of drivers make the daily decision of convenience over value.

Would I spend it for myself or on an impulse? Absolutely not.

The fourth, "the effect that the allegedly infringing use has had on the copyright owner's ability to exploit his or her original work" would directly challenge those who re-purposed copyrighted works where the publisher created accessible
