In any case, they’ll need some more admissible evidence to move forward in the first place. It’s not unreasonable to think that they might turn up a cell phone pic or something that wasn’t already disclosed.
Necessary, probably not, but as a matter of course, the strategy is to present all possible reasons your client is not guilty/not liable, not just the most likely. Anything less and you aren’t zealously representing your client.
Side note - as a matter of decorum, why would the judge say anything like “best wishes, except when the Knicks play the Lakers”. I might be meaningless banter in reality, but it can only look bad.
