No, I’ve tried that one and it’s no different than any other mobile shooter. It just doesn’t work as well as an actual controller
It’s really not, you can’t feel any buttons, you can only reasonably use two things at one time (two fingers) you can’t shoot while aiming and moving, and your fingers are covering part of the screen.

It’s not a secret, it’s just how it was programmed. It’s very common to simply disable stuff that you might want to make visible later rather than removing it from the scene entirely.
I don’t think it sets a legal precedent, but I’m sure it would influence people in other countries
