You're right. What is illogical about the Cursed Children is that they're the country's #1 weapon and they're kept on the outskirts and treated like trash. If a country basically relies on something that everyone hates and they are exiled, it's a recipe for disaster.

Legally, they cannot. Unless, the Yogscast says, "We are doing nothing. Go home and cry," which violates Kickstarter's Terms and Conditions. Even then, it would most likely need to be Kickstarter suing them.

Nintendo isn't doing anything because it can't. In the past, they have reached out to third parties and we're rejected. So they make up for it in Indie games. The eshop is full of them.

Just because a game has blocky/cubed aesthetic doesn't make it a Mine craft rip off. It's in its early stages and many developers use the style early on to focus on game play and other mechanics and change it later to their original vision.
