California has an exemption which is outlined in the federal clean air act. The exemption cannot be rescinded by a regulatory process it can only be removed via legislative action.

I have a NB2 Miata and have driven a few S2000s. I love the S2000 it’s better than the Miata at 10/10ths, but anything other than full boil to me the Miata is a better car. Fun in a Miata is much more accessible to the average person. You don’t have to ring the Miata’s neck to have fun, but of you want to you can.

You can’t compare someone working a standard minimum wage job and their expenses to an Uber or Lyft driver like that. More accurately you would have to compare it as if for example a minimum wage fast food chef was required to provide their own kitchen equipment and maintain it.
