I mostly meant systematically what capacity does a soldier have to challenge/refuse an order. Not so much mentally, is he smart or well informed enough to know if an order violates the Constitution or International Law. I would suspect mostly that type of insubordination would happen at the top. 4 star generals would…

What capacity does a soldier have to say “I think what I’m being asked to do violates the Constitution. So I cannot do it.” Cause it sounds to me like that’s a one way ticket to a court marshall and a dishonorable discharge.
