From the first episode it was made clear that Emmitt was years older. I only really picked up on that because I initially did think EM was going to be playing twins, and the humorous fact that they made the younger brother look so much older.

Since Emmy nominations will be announced before anyone has even seen the first episode of the new season, I'd say the rules are pretty fair in this instance.
