But the law isn’t some immutable thing nor was it designed to be. The law was created with a recognition that officials can and should use discretion. The terms you regard as narrow, such as hate speech, vary. Further individual places and organizations draft contracts which you must sign on to in order to use space…
I think where this case falls apart is in the school’s co-sponsorship of the event. They say the organizers didn’t tell them what they actually planned. The school’s cosponsorship/endorsement of the content is definitely illegal even though the content itself might not be.
Never works
Of course it WOULD be in the wrong, if it had not recognized that it was misinformed and rescinded its agreement. I have no idea why people think that a 1st-amendment right to speech that shall not be infringed by government means anyone can say anything anywhere. The substance of many actual 1st-amendment court cases…
Cahill had a duty to mitigate her damages
You should give the mother a “Sophie’s Choice” scenario: pay full restitution and remodel the clinic and your son gets time served or, he can cool his vandalous heels for the full-20 in prison.
Thank god! I’m going to petition my local school to host a porn shoot.
So this winner parent has 1) a kid who can’t read at 5, 2) writes an obscenity on his birthday cake, and 3) brags about it to Deadspin.
No, but making him drink formula out of his mom’s ass is.
Is bringing your five year old to the bar with you on Sundays the most Bills fan thing ever?
Yes I understand the point of the first amendment. That doesn’t mean I have to agree that free speech should mean elementary schools must house things totally inappropriate for children, even in off hours.
If a person stands in public and advocates the murder of a certain type of person, that’s an illegal offense. It has nothing to do with whether or not the space belongs to the government or not. When a church says “see? Being gay gets you shot and sends you to hell, where all faggots deserve to go” then yes, it’s…
agreed. and this never mattered with former Secretaries of State, apparently.
Because most private email servers do not act like yahoo. Most are configured to locally pull down the emails because of way they have been setup.
Setting aside the hate speech, I cannot imagine an elementary school would be forced to allow a group to depict actual recent murders in their facilities under the guise of free speech. Perhaps it is the case, but if so that is ridiclous.
Each hypothetical you’ve presented is incorrect. A positive and inclusive event is different than one with mock blood and guns. You’re bordering on homophobia. So get your facts right or stop.
Which Gay-Straight Alliance events have you attended that makes you think they’re comparable to scenes of incest, rape, and murder?
But there’s another factor- this is a school, not just any facility. The children who spend their days in this place identify strongly with it and need it to be a safe place. Is it at all appropriate to stage extremely frightening violence at these kids school? I don’t think so. You know they’ll see it, even if minors…
Sort of, but this sort of content is beyond the pale. Your argument is basically conflating and after-school prayer group with a Klan rally. As a gay person I think the Pulse thing is skimming the line of inciting violence against gay people. There are reasonable limits.
