That could be difficult, since the cars passed the tests as they were. Build better tests or stronger rules against ECU trickery next time.
Maybe, but surely most EC countries base their vehicle-pollution-taxes on the officially tested emissions when released? I haven’t heard of any provisions for tax being reassessed based on retests of a modified vehicle. These vehicles would have “passed” the tests as they were when released.

To be fair, auction revenue isn’t going to be huge, once we consider the seller’s fees, and the logistical stuff, and the low prices that many of these things sell for.
