I understand the question, but think it’s more accurate to say that this man is mentally incapable of consenting to sex, or likely even understanding what sex is. He has the mental capacity of a toddler. Do you think a toddler should be “barred” from having sex? Because I do.
IMO, this whole article reeks of someone playing at investigative journalism, and thus succumbing to false balance. We don’t have to hold in our head the notion that this women is not a rapist because she says she’s not a rapist. Just like we shouldn’t actually have to hear “both sides” concerning climate change.
A quick scan of the comments here seems to indicate a general agreement that this woman indeed raped her charge, because his mental faculties are so impaired that he is incapable of giving consent. And she certainly does sound unprofessional!
If she were a cis het dude it wouldn’t be a question. We’re so terrified of “giving women a bad name,” since under patriarchy a woman’s fuck up is our collective doom (see “How It Is” at xkcd), that we try to rationalize all the wrong shit we do. Kinda like I’m doing here? It’s ... not good.
We aren’t assuming that in this case, though. His doctors said that he has the mental capacity of a toddler. That’s not an assumption. I’m not saying that the assumption isn’t made a lot about people with disabilities, because obviously it is, but it hasn’t been made HERE.
