This is no more of a “protest” than flipping off a teacher behind his/her back to get a reaction from the class. Sure, you could arugue that the bird-flipper is protesting bad teaching. But in reality he’s not; he is looking for a low-effort way to get attention.

No. Because people generally sue with the intention of winning. The economics don’t work otherwise. Thiel et al. did not break the law; Gawker did. Suing people who did not break the law is generally a money-losing enterprise.
And if someone in the state of FL secretly taped Cohen and Gawker published it, they would be liable for damages. Look up the actual law that was applied in this case.
