I really don’t understand this marketing campaign for The Flash.
It wasn’t some legal loophole, they prosecutors made a deal not to charge him and then went back on it. You can’t do that, even if the person in question is terrible.
He doesn’t need it to be in public domain. Weird Al’s work doesn’t violate copyright (because parody is fair use, and he’s obviously parodic), he just prefers not to upset people, since his intention isn’t to actually mock them. The “asking for permission” thing is just him being nice.
I think he had a chip on his shoulder in those early days as most people viewed him as kind of a “slacker rock” act, while he was busting his ass making music and playing shows and doing everything possible to make it.
