I don’t really understand why you felt the need to link these hearings to the issue of due process in criminal trials. This is essentially a job interview. The standard isn’t “guilty beyond a reasonable doubt,” it’s “should this man have a lifetime appointment to the highest court in the land.” (Spoiler: No.)
