On a purely character level, this is the strongest argument I've seen against the "Walt did it" theory.  I wish it was possible to *completely* discount the possibility based on plot points, but as evidenced by all the comments, there are explanations possible, even if they're implausible.

Yeah, while there was no plausible way that could have actually happened, the shot from behind the toilet just seemed to build on the Godfather reference, so for a moment I couldn't help actually expecting Gus to pull a gun out. It would have been mind bogglingly silly, of course.
