I'm pretty sure critics get to decide fresh or rotten in all occasions. If they really were surprised, maybe there was an earlier time when RT made the decision, or maybe they just forgot.

I set a rule for myself that I would only select from series in which I had watched at least half the season (with actors, however, my rule was only one episode). So the real shame is that I've only watched three episodes so far.
