Yes, there have always been problems with the Ghandi/Samurai mashup that Star Wars didn't properly address. From everything I've read, SWG fucked up a lot of really good ideas, and WoW's runaway success made every potential AAA-MMO-developer immediately conclude that anything SWG did that WoW didn't was anathema to making money.

Uttering words to the effect of "the prosecution has failed to prove beyond a reasonable doubt that consent wasn't given, was given under duress, or was otherwise

Pretty much all of it, though to be more specific, the legal system is going to have a hell of a time turning a statement like "if you feel violated, then you've been violated" into any kind of a sane, reasonable, uniform rule. And I'm not sure what it's going to do about Mr. Penis-Arms either.
